Referral Program Terms & Conditions

These Terms govern participation in the Openvest Referral Program ("Program"). By participating, you agree to these Terms, the Openvest User Agreement, and all applicable disclosures.

1. Eligibility

   Open to registered Openvest users in good standing.

   Employees, contractors, and affiliates of Openvest may not be eligible.

   Openvest reserves the right to verify eligibility.

2. How the Program Works

   • Share Your Link

     Each eligible user receives a unique referral link.

     Share via personal channels (email, text, social media, etc.).

   • Your Friend Invests

     When your friend signs up and invests through your link, they receive a reward equivalent to $10 (cash, account credit, or Openvest shares at Openvest's discretion).

   • You Get $10

     For each friend who invests, you receive a reward equivalent to $10.

     Rewards may be delivered as:

     Cash or account credit, or

     Openvest investment units/shares with a value equal to $10 at the time of issuance (determined by Openvest).

     Rewards are capped at $1,500 per user.

     Delivered at the end of the following month.

3. Restrictions

   No self-referrals, duplicate accounts, or posting links on coupon/deal sites.

   No misrepresentation of Openvest or paid ads to promote links.

   Rewards are only issued for qualified referrals (new customers who sign up and invest).

   Openvest may deny rewards for fraudulent, abusive, or suspicious activity.

4. Taxes

   Rewards, whether in cash, credit, or shares, may be taxable.

   Participants are responsible for any tax reporting and payments.

5. Program Changes & Termination

   Openvest may change or end the Program at any time.

   If ended, eligible earned rewards will still be honored.

6. Liability & Disclaimers

   Openvest is not responsible for lost, delayed, or misdirected communications.

   Participation is at your own risk.

   All decisions on eligibility and rewards are at Openvest's sole discretion.

7. Governing Law & Dispute Resolution

   These Terms are governed by the laws of Delaware, USA.

   Any dispute, claim, or controversy arising out of or relating to the Program will be resolved exclusively by binding arbitration in Delaware, under the rules of the American Arbitration Association (AAA).

   No jury trial: You and Openvest waive any right to a jury trial.

   No class actions: All disputes must be brought individually. Class, consolidated, or representative actions are not permitted.

   Small claims carve-out: Either party may bring an individual claim in small claims court if the claim qualifies under applicable law.

   The arbitrator's decision will be final and binding, and judgment may be entered in any court of competent jurisdiction.
